Application of jurisprudential principles concerning the anti-sodomy law (A case study in Malaysia)

On the 6th of December 2007, the Royal Malaysian Police raided a health centre in Penang while thirty seven men were found in a gay ‘mini sex fest’. However, the guys of 2 foreigners and others of local ethnic Chinese were later released.
They could have only been charged with abusing the use of the premises for purposes other than it was licensed for. Their lewd ‘fest’ could have constitute prosecution under section 377D of the Penal Code that is outrage of decency whether it was public or private which could have tantamount to two years imprisonment if found liable.
Sodomy has not been expressly recognized in the Penal Code.
